Reconstructing the Fourth Amendment: A History of Search and Seizure, 1789-1868
Rape and the Culture of the Courtroom (1999)
This book argues that rape law reform, particularly concerning the evidence admissible at trial, has failed because it has not appreciated adequately the teachings of linguistics and psychology concerning how language practices influence perceptions of credibility. Drawing on elite and popular fiction, empirical data on gendered language perceptions, and feminist theory, the book seeks to articulate a theory of "feminist evidence law" and to apply it to articulate a better model for rape law reform in this area. Whether practical politics permits such reform is another matter altogether.
